Needless to say, it's a welcome change of pace. We have been touting the coming of good things for quite a while and it now seems as if good things have indeed begun to happen.&lt;br /&gt;&lt;br /&gt;Single family brokers have been &lt;span class="blsp-spelling-corrected" id="SPELLING_ERROR_0"&gt;experience&lt;/span&gt; a uptick in business since the start of the spring market. According to most of the brokers we know, that uptick is a direct correlation to 3 main factors: improved sentiment among the public, low interest rates and the $8,000 tax credit.&lt;br /&gt;&lt;br /&gt;While we are busier than before, I am still surprised by the lack of young, first time buyers looking to start their portfolio by purchasing a 2, 3, or 4 unit utilizing these incredible tools available to them.&lt;br /&gt;&lt;br /&gt;Don't get me wrong, I understand times are still very tough for many people, and that can cause folks to be extra cautious. Great content!&lt;br /&gt;&lt;br /&gt;Alright, everybody take a breath and let’s talk about what REALLY is going on.&lt;br /&gt;Business television and newspapers are abuzz this morning with talk of "four and a half percent mortgage rates". The talk stems from a leaked story that the U.S. Treasury MAY intervene in the mortgage market, IN AN ATTEMPT to lower rates by AS MUCH AS a full percentage point below their current levels. Wow. That’s pretty specific.&lt;br /&gt;As cited by the more responsible journalists however, the story is 100% speculation. Naturally, that doesn't stop the press from covering it. And, of course, it creates a wild frenzy of excitement in the real estate and mortgage industry and for homeowners. My message to Realtors and homebuyers in escrow or house-hunting and to homeowners who are refinancing is simple, and I state this with the full knowledge that at first glance some will think this self-serving – do not make the mistake of thinking that this hub-bub about 4.50% rates is a done deal. Do not stop your transactions or house-hunting based on something that may just as easily not happen. Talk this over in detail with your Realtor and mortgage professional and determine, for YOUR specific situation, what is the best course of action. As is the case with all things speculative, it's important to remember to look at the facts and not be swept up by the media-sponsored frenzy. So what are the facts? Here’s what we know:&lt;br /&gt;1. The Fed and the Treasury do not set mortgage rates – Mortgage-Backed Securities traders do, based on simple supply and demand. Look at the chart below. This is today’s chart of the price of mortgage-backed securities. Notice that nothing significant has happened today (last green bar to the right). Right now, the price of mortgage-backed securities is up only 12 basis points. Price going up means rates improving. 12 basis points is nothing, and won’t even get a lender’s attention. Note also that on Tuesday, Nov. 25th (tall green bar 6 bars to the left of today), when the Fed announced their plan to purchase $500 Bn of mortgage-backed securities, prices immediately shot up 156 basis points. That move gave us an immediate improvement in mortgage interest rates of .50%. and that was before the Fed spent even $1 on any mortgage-backed securities. That is because the market is forward-looking and prices-in known factors immediately. Today’s speculative rumor has given us nothing, so obviously traders and mortgage bond investors do not believe it. Mortgage rates have actually worsened in the last 3 days.&lt;br /&gt;2. Treasury or Fed intervention doesn't guarantee low rates indefinitely. The fact that mortgage rates are up by a quarter-percent since last week proves it.&lt;br /&gt;3. Zero details about the plan have been confirmed. Everything you've heard about 4.5 percent rates is a guess at this point.&lt;br /&gt;In order to ground my conclusions for this email, I sought out everything I could find about this story and have included some excerpts below for your review. By one account, the new program would be available only to home buyers, not to people who simply want to refinance their existing loan at a lower rate.” via NYTimes.com&lt;br /&gt;Mortgage News Daily - The Journal reported that the government would encourage banks to issue new mortgage loans at lower rates by offering to purchase securities backed by the loans at a price equivalent to the 4.5 percent rate, funding the program by issuing Treasury debt at 3 percent. The Treasury Department plan is only in the talking stage and may not be ready until after President Bush leaves office on January 20 at which point it would be necessary for President-elect Obama to sign off on it.&lt;br /&gt;CNN Money - Lobbyists are pushing the Treasury Department to consider a plan to purchase mortgage-backed securities in the hopes of driving mortgage rates to as low as 4.5%, an industry source said. Spokeswomen from Treasury and the Federal Housing Finance Agency, which oversees Fannie Mae (FNM, Fortune 500) and Freddie Mac (FRE, Fortune 500), declined to comment.&lt;br /&gt;"It is clearly designed to bring buyers into the marketplace and soak the inventory of unsold homes," said Greg McBride, senior financial analyst at Bankrate.com. But others questioned whether rates would remain low and, even if they did, only a narrow slice of credit-worthy borrowers would benefit. Rates are already inching up, hitting 5.75% on Wednesday, said Keith Gumbinger, vice president of HSH Associates. Several government attempts to lower mortgage rates this year have failed to have a lasting effect.&lt;br /&gt;Finally, super-low rates could keep private investors out of the mortgage-backed securities market, forcing the government to remain the primary buyer of such investments, Gumbinger said. "I can't imagine there will be a significantly active marketplace of people who want to buy at these low rates," he said. (That would not be an acceptable long-term situation, and the Treasury knows that.)&lt;br /&gt;Thomas Vanderwell had this to say on his blog “Straight Talk About Mortgages:&lt;br /&gt;“So far, the market has shown that they would rather earn less (frankly close to zero) and invest in US Treasuries than they would invest in mortgage backed securities. Given the history of Fannie and Freddie recently (how many billions did they lose in the 3rd quarter?) I’m not sure anyone can blame them. Can you?&lt;br /&gt;So if investors are avoiding Mortgage backed securities like the plague, and there are trillion of dollars of them out there, will the interaction by the Fed make a difference? And if no difference is made, how will we get 4.5% mortgage rates? Lehman Brothers goes under, Merrill Lynch gets absorbed, AIG gets bailed out, and to cap it all off? The Fed leaves rates alone.&lt;br /&gt;&lt;br /&gt;After much speculation that it would cut rates, the Fed surprised most by, in what appears to be a plea to stay calm, leaves the federal funds rate at 2%. The Fed asserted that the rate is already low enough to spur economic growth. Despite investors disappointment, the market rallied late anyway.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;While the Fed's rate has no direct impact on mortgage rates, when lowered it does pump money into the economy, heightening confidence and generally loosening the money clips of most mortgage investors.&lt;br /&gt;&lt;br /&gt;On the bright side, lenders are seeing (for the first time in quite a while) a renewed influx of existing borrowers looking to refinance as rates have already dipped to enticing levels; perhaps the fed knows what its doing after all???&lt;br /&gt;&lt;br /&gt;With the financial markets seemingly coming apart at the seams, many are burying their heads in the sand, fearing the worst and opting to horde cash rather than look for opportunities. This short sightedness is unfortunate given most investors do quite well in times of uncertainty, assuming they know where to look.&lt;br /&gt;&lt;br /&gt;Bottom line: The environment is ripe to purchase. The broker who knows about it (and likely has a written agreement with the seller) considers this a pocket listing... one which he or she has access to, but other brokers do not. For obvious reasons, this is highly advantages to the broker who has the relationship with the potential seller.&lt;br /&gt;&lt;br /&gt;As a buyer, it is a benefit to work with a broker who has access to all of the inventory, beyond what is listed on the MLS. That was it. We consolodated and focused our efforts on one very specific market. We grew and became very succesful as a result.&lt;br /&gt;&lt;br /&gt;Over the years, we've expanded into larger commercial-sized buildings and into sub markets of Portland and even other cities. We've always been high on Portland due to the inherent value and long-term equity potential. What we run into, however, are investors who (like most investors) want the numbers to "work". While it is not always clear exactly what that means, it generally refers to cash flow... something that is particularly elusive in Portland. &lt;br /&gt;&lt;br /&gt;The solution? Well, I just put a client under contract to purchase a 6-family building in Biddeford listed for $150,000. The building consists of six 2 bedroom units, needs cosmetic and some electrical updating. Not bad, huh?&lt;br /&gt;&lt;br /&gt;What's the catch? The catch is, you now own a 6-unit in Biddeford! Regardless of how the numbers look on paper, you now own and need to manage a building in a market that is notoriously hard on owners. Not that there's anything wrong with that... but it is work. The client who is buying this building happens to be a pro and already owns and manages many units in that market. She's doing it right. She has consolidated and focused her efforts and resources to become successful in one particular market. It is labor and management intensive, but it can be done.&lt;br /&gt;&lt;br /&gt;The moral of the story? In a real estate market where everyone is looking for a deal, know your strengths and limitations. Having a down payment and ability to finance does not make buying a big cheap building in any city a slam dunk. You've got to possess the ability to follow through and manage your investment to it's highest potential. Up until recently, potential buyers were adamantly opposed to pulling the trigger until they "saw the bottom". &lt;br /&gt;&lt;br /&gt;Have we seen or at least reached said "bottom"?&lt;br /&gt;&lt;br /&gt;There is something in the air now that's been noticeably absent in recent months: people are actually looking at and buying real estate. Savvy investors are capitalizing on opportunities and first-time owner occupants are moving in on 2,3, and 4 units. Hooray!&lt;br /&gt;&lt;br /&gt;Lenders are still very tight-fisted and conservative, but there are some signs that even they are starting to come around. I've heard some very positive things with regard to both owner occupants AND investment programs. In the article, I breifly outline the "short sale" process and what it entails. The column will run on Sunday July 6, 2008: &lt;br /&gt;&lt;br /&gt;As a result of the current “mortgage crisis”, many folks who over-leveraged in order to purchase property in the last several years are finding themselves precariously close to losing their home or investment to foreclosure. In certain instances, a short sale is advantages to both the flailing property owner and a savvy investor. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;A short sale is when a bank or mortgage lender agrees to discount a loan balance due to an economic hardship on the part of the mortgagor. The home owner sells the property for less than the outstanding balance of the loan, and turns over the proceeds of the sale to the lender in full satisfaction of the debt. In such instances, it is required that the lender approve the proposed sale.&lt;br /&gt;&lt;br /&gt;This sounds like a no-brainer to an investor as in most cases the property is acquired for much less than what the appraised value was a short time ago. However, these transactions differ from conventional transactions in several ways. &lt;br /&gt; &lt;br /&gt;First, expect the process to take 90 to 180 days (or more). There are often several tiers of approvals required, depending on the lender. &lt;br /&gt;&lt;br /&gt;Second, understand that you are dealing with a seller who’s motivation to sell is limited only to avoiding foreclosure. They stand to gain nothing else; if that is not sufficiently important to them, their actions may seem irrational and counter-productive to getting the deal closed.  &lt;br /&gt;&lt;br /&gt;Thirdly, the property has likely been neglected and will probably need some amount of work in order to be brought up to par. &lt;br /&gt;&lt;br /&gt;An investor’s ability to work through the obstacles is essential to securing a property through short sale. We have certainly seen the effects here is this office, but not neccesarily in the ways you would expect. Prices have definitely made an adjustment downward, which can be good or bad, depending on which side of the table you are sitting. But business hasn't ground to a halt as some outlets would lead you to believe. Instead we are seeing more "creative financing" if you will, and more people being able to jump on opportunites that just weren't there before. Last month Chris talked about a property that sold as a bond for deed, and since that post we have completed another. Our current contracts include three short sales, and our closings in the last few months have included several seller financed properties. So the story right now seems to be the following:&lt;br /&gt;&lt;br /&gt;1) Now is a good time to buy but you will probably need some cash in your pocket to do it. Gone are the days when anyone with a pulse could buy property, but there are loans out there and people are starting to come down on their prices.&lt;br /&gt;&lt;br /&gt;2) There are financing options out there if you don't have much cash. Seller financing can be a really good option for both buyer and seller. Short sales can be long projects without guarantee, but can be a good investment if you have the patience and time. Bond for deed gets you instant equity if you find the right property and can get the seller to bite, though it is a riskier option to both parties.&lt;br /&gt;&lt;br /&gt;3) If you are handy, this is a great time to buy. There are fixer-uppers coming onto the market regularly and with prices moving south you can make the sweat equity work if you aren't afraid to dive into the project yourself.&lt;br /&gt;&lt;br /&gt;4) Make a low offer if you have the comps to justify the price. In some cases properties are going for significantly less than they are listed for simply because that is where the value is shifting and the evidence is there to prove it. In the last two weeks alone, 18 units have gone under contract. The Sullivan Multi Team put four units under last week alone and are activly negotiating several more contracts. In the email, the owner stated that she and her husband had purchased the building in February of 2006 and made about $35,000 in capitol improvements. They now live forty-five minutes away and are tired of traveling to mange the building. She wondered if she could sell now and make her money back, or wait a year and try then. Below is my response to her inquiry:&lt;br /&gt;&lt;br /&gt;“ In my mind, the most notable factor in Westbrook real estate values for the coming months will be the reassessment which is going to drastically increase property tax, including investment and owner occupied multi family property. Historically, Westbrook has been a nice alternative to Portland for investors looking to capitalize on the proximity to Portland, yet earn more of a return on their investment due to lower prices, lower taxes and comparable rents. This increased expense coupled with rising interest rates will put pressure on values and stagnate prices. I don’t see your building going up in value over the next year.”&lt;br /&gt;&lt;br /&gt;I hate to give someone bad news, but there are some valuable lessons here:&lt;br /&gt;&lt;br /&gt;1. Never buy a property that is out of the way for you to manage. No matter how good the numbers look on paper, over time, your time is worth something and you should be cognizant of this when looking for investments.&lt;br /&gt;&lt;br /&gt;2. Unless the climate is ripe for a flip, plan on holding on to your investment for five years or more. Longer is better. If you are not familiar with a bond for deed, as explained by John Graham, it is a mechanism whereby the title is held in escrow by the seller's attorney until payment in full is received from the buyer. The seller’s current mortgage(s) stay in place and the buyer pays the seller an agreed upon monthly payment and the seller then uses this money to pay the mortgage holder. The buyer is responsible for all management, upkeep, expenses, taxes and insurance, ect. The buyer owns the building but uses the seller’s current mortgage.&lt;br /&gt;&lt;br /&gt;If the buyer does not pay, the seller can take the building back over in as little as forty five days. The risk for the seller is that the building could potentially be managed poorly or allowed to be run down.&lt;br /&gt;&lt;br /&gt;The risk to the buyer is, while doing capitol improvements and paying the seller on time, the seller could potentially stop paying the mortgage. In that scenario, the bank could foreclose, leaving the buyer with no recourse.&lt;br /&gt;&lt;br /&gt;As bad as everyone feels about the sluggish pace of the market lately, this climate seems to bring out the serious investor who knows an opportunity when they see one. By 10:00 AM Monday morning, we had scheduled 5 showings for 5 different properties - a record for Sullivan Multi in any market and simply amazing in this down market. It would not have occurred to us that the election was a factor except that we had noticed a similar pattern two years ago.&lt;br /&gt;&lt;br /&gt;Back in 2004, our first year in business, we had a nice two unit listed near Woodford's corner. The property had a steady run of showings up until a few weeks prior to the Presidential election. The showings dried up and we were forced to question the price. Remember, two years ago, we were in the middle of a very hot market. The election never occurred to us as a factor to consider.&lt;br /&gt;&lt;br /&gt;After much debate, we recommended to the seller to hold to his price. Sure enough, the week following the election, the showings picked-up and within two weeks the nice two unit was under contract.&lt;br /&gt;&lt;br /&gt;The beginning of September was busy for about two weeks but then buyer activity slowed significantly. Post-election Monday came and the phone started ringing off the hook. The buyers are back! While I don’t have scientific proof of cause and effect relative to the election, the pattern seems pretty clear. It is a good reminder to keep global events in mind in the midst of local issues, seasons, weather, and the holiday season.&lt;br /&gt;&lt;br /&gt;Everyone is trying to figure out this new real estate market. Is the bubble bursting? Many believe that the spring will tell the truth. How do you know?&lt;br /&gt;&lt;br /&gt;As we go through many apartments in the Greater Portland area, we often surprised at the great disparity in rents. One day we see an average 3 bedroom for $1000/mo in a marginal area of Portland. The next day we see a 3 bedroom with parking and water views for $950/mo with heat included! What gives?&lt;br /&gt;&lt;br /&gt;There are two explanations. First, most experienced landlords rent units just below market value. This enables them to find good tenants and makes it hard for those good tenants to leave. Avoiding turn-over is the gospel of successful landlords!&lt;br /&gt;&lt;br /&gt;The second reason for low rents is simply the landlord’s lack of awareness. You do not know what other similar units are renting for if you are not out looking. So get out there. Read the paper, search on craigslist.com, and see what other similar apartments are renting for.&lt;br /&gt;&lt;br /&gt;In the short term, low rents result in a significant loss of potential income (obviously). For example, $100 per month under market in three separate units is $3,600 per year of lost pre-tax income. What if you invested that money?&lt;br /&gt;&lt;br /&gt;There may be an opportunity to raise your rents even higher! We see all kinds of creative ways that some landlords get higher-than-market rents. How about furnishing your apartment? If your property is in a nice part of town, tenants may pay up to $200 more per month for a furnished apartment. How about finding a business that needs corporate rentals. You are the investor! Find the angle! There is always a way to do a little better than the average landlord and see a significant return over time.&lt;br /&gt;&lt;br /&gt;Finally, in today’s buyer’s market, higher rents equal higher prices.
